These Terms and Conditions apply to all sales of goods by Elite Crete Ltd to trade customers purchasing via our website, by email, by telephone or in person. By placing an order with us, you agree to these Terms.

TRADE CUSTOMERS
Our products are supplied primarily for professional and trade use. By placing an order, you confirm that you are purchasing in the course of business and that you or your installers have the appropriate knowledge and experience to use the materials correctly and safely.
Nothing in these Terms removes any statutory rights that cannot legally be excluded, but our products are not intended for consumer or DIY use without appropriate expertise.
ORDERS & ACCEPTANCE
All orders are subject to acceptance and availability. A contract between you and Elite Crete Ltd is formed only when payment has been received and the goods have been dispatched.
We reserve the right to cancel or refuse any order where stock is unavailable, pricing errors occur, or we reasonably suspect fraudulent activity. If we cancel an order after payment has been made, a full refund will be issued.
PRODUCT INFORMATION
We make every effort to ensure that product descriptions, images and technical information are accurate and helpful. However, images are for illustration only and colours, finishes and packaging may vary slightly between batches.
Any technical guidance or advice we provide is offered in good faith but is for general guidance only. It is the customer’s responsibility to ensure that products are suitable for the intended use and conditions of the project. We strongly recommend that samples and site tests are carried out before full application.
PRICING & PAYMENT
All prices are shown in GBP and exclude VAT unless otherwise stated. Delivery charges are calculated separately unless clearly included.
Full payment is required at the time of ordering. We do not offer credit accounts. We reserve the right to correct pricing errors and to cancel any order affected by an obvious mistake, in which case a full refund will be provided.
DELIVERY
Delivery times provided are estimates only and are not guaranteed. While we always aim to dispatch promptly, delays can occur due to courier issues, supply chain disruption, weather conditions or customs processes.
Many orders are delivered via pallet courier. It is the customer’s responsibility to ensure that the delivery location is accessible and suitable for pallet delivery, and that appropriate arrangements are in place to receive and unload the goods. If delivery fails due to access issues or no one being available to receive the goods, additional delivery or storage charges may apply.
Risk in the goods passes to the customer upon delivery or collection. Customers must inspect goods as soon as reasonably possible and notify us within 48 hours of any damage, shortage or incorrect items, providing photographs where possible. If we are not notified within this time, the goods will be deemed accepted.
INTERNATIONAL SHIPPING
We are happy to ship internationally. For orders outside the UK, the customer is responsible for all import duties, taxes, customs fees and local clearance requirements. Delivery timeframes for international orders are estimates only and may be affected by customs procedures in the destination country.
If goods are returned or refused due to unpaid duties or failure to clear customs, the customer will remain responsible for all associated costs, including return shipping and handling charges.
RETURNS
As we supply trade materials, returns are limited. We may accept returns at our discretion where goods are unused, in their original packaging and reported within seven days of delivery. We are unable to accept returns of used products, opened chemical materials, custom or special-order items, or products that have been tinted or made to order.
Return shipping costs are the responsibility of the customer and a restocking charge may be applied where appropriate.
RETENTION OF TITLE
All goods remain the property of Elite Crete Ltd until paid for in full. Until ownership passes, customers must store the goods safely and in a way that allows them to be clearly identified as our property. Where payment is reversed or disputed, we reserve the right to recover goods that remain unpaid.
PRODUCT USE & INSTALLATION
Our materials are intended for use by trained professionals. We cannot accept responsibility for issues arising from incorrect installation, unsuitable substrates, site conditions, or failure to follow product instructions and guidance.
We are also not liable for colour variation between batches, normal product characteristics, labour costs, project delays or any third-party losses. Customers are responsible for ensuring that the products are appropriate for their specific application and for carrying out any necessary testing before use.
CHEMICAL PRODUCTS & SAFETY
Some of the products we supply are chemical-based and must be handled and used with appropriate care. Customers are responsible for ensuring that Safety Data Sheets are read and followed, that suitable personal protective equipment is used, and that all relevant health and safety and COSHH regulations are complied with.
We cannot accept liability for misuse, unsafe handling or storage of chemical products once supplied.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, our total liability in connection with any order shall not exceed the value of the goods supplied. We shall not be liable for loss of profit, loss of business, project delays, labour costs or any indirect or consequential losses arising from the use of our products.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.
FORCE MAJEURE
We shall not be liable for any delay or failure to perform our obligations where this is caused by events beyond our reasonable control. This includes but is not limited to severe weather, transport disruption, supplier shortages, industrial action, government restrictions or other unforeseen circumstances.
WEBSITE CONTENT
All content on our website, including images, product descriptions, logos and branding, is the property of Elite Crete Ltd and may not be copied, reproduced or used without our written permission.
ORDER CANCELLATION
Orders cannot be cancelled once they have been dispatched. We reserve the right to cancel any order prior to dispatch where payment fails, items are unavailable or we reasonably suspect fraudulent activity. In such cases, a full refund will be issued.
GOVERNING LAW
These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising in connection with them shall be subject to the exclusive jurisdiction of the courts of England and Wales.
